I.  WRONGFUL FORECLOSURE & WRONGFUL EVICTION

I haven't written about this subject and I don't know why I did not get to it sooner. I write for this website to inform Borrowers instead of trying to sell you some old myths and lawsuit templates. I am a victim myself and it has been a continuous painful ordeal as other problems hold you back from any recovery.  

Mortgage Fraud is the largest and most disruptive and wretched plague that any United States Congress has intentionally cast over a certain group of citizens.  To say that Congress targeted and complied with the demands of Wall Street is a disgraceful thought with limits.  But, the key to wrongful foreclosures is the judicial system.  Its the judges who have systemically and universally cooperated in the largest Ponzi scheme in the history of the world by issuing rulings and orders in favor of Imposters and Fictitious Payees (legal terms defined in the Uniform Commercial Code (UCC) defying logic and simple evidence.  


Most judges are putting the burden of proof on the Defendant (Borrower), or, actually, they are just doing nothing to stop the Borrower from trying to prove that the foreclosing party has committed fraud and doesn't have the right to collect money or foreclose on him. Therefore, the Plaintiff (foreclosing party) appears to have Standing to bring this foreclosure lawsuit before a court. But, that is wrong.  The Borrower has no obligation of the burden of proof of Standing.  This violates the Article III Standing definition of the US Constitution which clearly places the rules of burden of proof on two parties.


THE FIRST PARTY which bears the burden of proof to prove STANDING is the foreclosing party:


A Plaintiff that wants to bring a lawsuit before a court must claim to have suffered an injury and proved it with "concrete and particularized" evidence.  Without the Plaintiff having an injury to claim, there can't be a genuine dispute for the court to settle.  So, the alleged foreclosing party Plaintiff's original lawsuit must have words in it that prove "beyond a reasonable doubt" that it is owed money because it paid some money and someone didn't give it back.  I learned from a mentor years ago to not just read a contract (a home loan agreement is a contract), but to read it literally, "what do the words say"?

GMAC MORTGAGE, LLC, (or similarly named entities), ROBO-SIGNING, THE KING OF ROBO-SIGNING JEFFREY STEPHAN DEPOSITION CONFESSION, 60 MINUTES, MILLIONS OF STOLEN HOMES, AND BANKRUPTCY FRAUD

I am as frustrated right now as I have ever been during the 5 years that I have been fighting mortgage fraud.  In the movie "The Big Short" towards the end one of the Wall Street characters is frustrated that a group of them has figured out how massive the fraud in mortgages has been. 

They even know who the worst perpetrators are beginning with Fannie Mae and working down through Citi Mortgage and the rest.  They have gone to all the big newspapers to blow the whistle just knowing in their minds and hearts that this is a near apocalypse and the biggest story in history.  Not one newspaper editor or reporter will give them the time of day.

1.  Because a fraud this large was too big to believe and 


2.  The newspapers' biggest stock owners were the same criminals running the fraud.


As they are walking back toward their office one of them muses, "I was afraid we were going to create panic in the streets.  I was sure that once people knew that their retirement plans had been ransacked by their own government and banking industry that we would have an actual revolution, an uprising by all Americans.  But look at them walking on along the street completely unaware and without enough background information to even get an inkling of what's going on.  And it's not their fault, they shouldn't have to worry about their lives being destroyed from within."


That's how I feel.  There are a scattered few around the country screaming their lungs out in warning, but the message isn't getting through.

I need to let one of the dupe perpetrators explain it to you himself.  What could be more powerful?

My 2nd most popular posting of all time on this blog is the one about GMAC/ResCap fraudulent bankruptcy where literally millions of homes are being taken from families by players like Fannie Mae (thank you US government), Ocwen, Nationstar, Green Tree, Seterus without any ties to the players they are stealing from.

My house is one of them.  The post was popular because this fraud is an especially complicated set of lies in the Federal Bankruptcy Court and it involves millions of families that cannot get any reliable information. I am one of them.

Remember the term Robo-Signing?  It isn't a real legally defined crime with that name.  That name came from the 60 Minutes news program that covered the newly discovered attorney counterfeited assignments that were forged by people who had not done any more than finished high school.  One (we will have to go into detail about him later) was recruited from a job in a carnival called Bears and Fairs.

But, the most infamous and notorious of them all is Jeffrey Stephan.  He has worked for GMAC (pick your own rest of the name of the company) for more than ten years.  He has confessed under oath twice in depositions to forging 10,000 mortgage documents per month with a group of ten people.

But, now I'm running into the problem again where I am explaining what they were doing. Jeffrey tells it all in the two depositions.  He was not indicted and after reading it you will believe that he did not know what he was doing.

I am not posting the 2nd deposition of the most notorious Robo-Signor of them all because you
will learn something new.  It is because you won't. Jeffrey Stephan describes in tortured detail the
forging of fake assignments of American families home loans at a rate of 10,000 counterfeited and
forged assignments and Promissory Notes per month by ten GMAC Mortgage Corp and GMAC
Mortgage, LLC employees in one group.

The GMAC Mortgage, LLC attorney, Frank Lipsman of Kansas City, is doing everything he can
to steal my home in a federal court case had to admit in Discovery that Jeffrey Stephan worked
for six more years for GMAC Mortgage, LLC, before going to work for Ocwen Loan Servicing
an even more damaging racketeering heir to the mountain of GMAC faked paper of millions of
loans.  This was all approved by the 2nd District Federal Bankruptcy Court Judge Glenn.  This
all public records.

#1  Ms. Kendra J. Stockdale Associate Circuit Court (Sewer Court) Judge from The 16th Circuit State Court of MO.  She committed the flagrant violations of "Lack of Standing for the Plaintiff and therefore Lack of Subject Matter for her Court  While she was ruling against ME!

She achieved number 1 not because she committed the same crimes as the others but because she is the most arrogant little toady of any of the judges below.  She is first even though she is the last one that showed how much contempt she has for the same American Constitution that she swore an oath to protect and defend.  Her contempt for the same Americans who pay her salary (which she has not been earning.  Ms. Stockdale will go to the federal court.  (Keep those memberships rolling in)

#2  Ms. Mary Elizabeth Phillips Chief Justice of the Federal United States District Court of the Western District of Missouri.  Nominated by Obama in 2011 and named chief justice in 2019.  She has my house case.  Soon I want to quote her on this Blog for all of the stupendous drivel that oozed out of her when making Orders and Rulings.  For most of six years, I thought she was handicapped and could not learn.  But, in 2019 her orders became manic and unintelligible.  I first suspected, then I knew that she was the very first judge that I had more than suspected of being on the take.

All of my clients reference the probability that their judges take bribes.  I held out for seven years.  I believed, well I guess, I wanted to believe that it would be the courts that would save the day.  Nope. Again another nope.   CONTINUE READING
